General Terms and Conditions of Sale for Rêve de Nav’ Croisière
Article 1: Reservations
Passengers must book their excursion in advance.
Any specific health condition must be declared at the time of booking, as stated in Article 6-2.
Pregnant women and individuals with disabilities or any health issues are required to inform us at the time of booking.
It is advisable to make reservations as early as possible, considering the limited number of places on board the vessel and the demand, especially during peak season.
The company accepts online reservations via its website www.revedenav.com and by phone.
Any reservation without payment cannot be confirmed.
Minors are only allowed on board if accompanied and under the responsibility of their parents.
Pets are not allowed on board.
Article 2: Schedules, Routes, and Excursion Prices
The company offers several excursions at different prices.
Schedules and excursions are defined at the time of your reservation. The website, brochures, panels, and advertising posters presenting the excursions do not constitute a contractual document. The information provided is for informational purposes only. Programs may be subject to changes.
Indeed, modifications to these schedules and routes may occur during the season due to weather conditions, sunrise and sunset times, etc.
Like the schedules, prices may vary based on the season, events, demand, or changes in economic conditions (surcharges, fuel costs, etc.) or changes in taxes (VAT, port and usage fees).
Prices include all taxes (TTC).
Passengers will know the schedules, routes, and prices at the time of their reservation via the website or after contacting the company for inquiries.
However, the departure and arrival times announced at the time of booking may be advanced or delayed due to any difficulties encountered by the ship’s captain.
Moreover, weather conditions may require the captain to modify the originally planned excursion route.
In such cases, the excursion price will be adjusted.
In any case, passengers will be informed of any changes to schedules, prices, or routes.
Under no circumstances shall such a modification justify the payment of any compensation to the passengers.
The carrier reserves the right, at the discretion of the captain and for reasons inherent to navigation, to make stops other than those planned or to modify the original route. The captain is allowed to tow, assist vessels in any situation, divert, perform rescues, and conduct any transshipments. Neither the captain nor the company can be held responsible for any diversions, modifications, service interruptions, or delays in the departures and arrivals of the vessel, nor for the non-coincidence of arrivals, departures, or connections with ships, planes, and trains.
Article 3: Cancellation
3.1- Cancellation by the Company
The company reserves the right to cancel a group excursion without prior notice or compensation if the minimum passenger quota is not met, in cases of force majeure, unforeseen circumstances, bad weather conditions, accidents, any malfunction, for safety reasons, or any other legitimate reason.
Only the ship’s captain is authorized to judge whether the weather conditions permit the execution of the excursion.
If the departure of the vessel is prevented or delayed due to any of these exceptional events, the company declines any responsibility for the costs and direct or indirect damages incurred by the passengers.
Rêve de Nav’ commits to informing passengers as soon as it becomes aware of any difficulty affecting or preventing the excursion from taking place.
The company will strive to offer an alternative to passengers, notably rescheduling the excursion, depending on the company’s availability, without passengers being able to claim any compensation, refund, or indemnity.
In the absence of an alternative solution proposed or accepted, passengers may request a refund for the entirety of their tickets from the company.
Refunds will be made using the same payment method used by the passenger when making the reservation. Please note that banking fees may apply depending on the payment method.
3.2- Cancellation by the Passenger
The passenger has the option to cancel their reservation for any reason and at any time.
However, they will only be refunded or exempt from paying for their ticket if the cancellation is made at least 72 hours before the scheduled departure time of the excursion. Please note that transaction fees may apply depending on the payment method.
Otherwise, the passenger will be required to pay the full ticket price, and the company will not be liable for any refund or compensation.
Registered participants cannot claim unfavorable weather conditions to request a refund of the amounts paid.
Partial absences of group members within 72 hours will also not result in any refund or compensation.
Article 4: Payment Terms
Ticket payment is made at the time of booking.
The company accepts payment by e-transaction, holiday vouchers (ANCV), and cash.
Passengers can pay directly online on the company’s website or by appointment at the marina in Rivière Sens or Vieux-Fort.
Payments in cash or by paper holiday vouchers must be made before the day of the cruise. No payment is possible during boarding.
A valid email address is required at the time of booking to receive your digital ticket. The validity of the email address is the client’s responsibility.
Tickets are issued only upon full payment.
No change will be given on holiday vouchers.
Article 5: Validity and Non-transferability of Tickets
Tickets are valid for the current season and for the date specified on the ticket. They are non-transferable.
Article 6: Embarkation and Disembarkation
6.1- Conditions of Embarkation
Passengers must present themselves at Dock 7 at the time indicated on their ticket. The dock gate is closed to anyone coming from outside. The skipper will open the Dock 7 gate at the exact time noted on the ticket.
No delays are accepted by the company. Any delay of more than 15 minutes may be considered by the company as a cancellation, even if the captain has been informed by the clients, and departure may proceed without them.
In case of delay, even with a valid ticket, the passenger will have no recourse against the company if they cannot board.
The embarkation and disembarkation of passengers takes place in the presence of the captain, who directs his passengers and indicates how to board and disembark.
Only passengers who have reserved their place and present a valid ticket are allowed to board.
The ticket must be kept by the passenger in good condition throughout the journey.
The company reserves the right to refuse embarkation to a passenger or a group of passengers presenting themselves for embarkation without a reservation or without a ticket.
The captain has the authority to refuse embarkation to anyone whose physical or mental condition does not allow them to participate in the excursion or to anyone who has consumed drugs, hallucinogens, or alcohol that could make their behavior dangerous to other passengers. In all the cases listed above, the passenger will not be able to avoid their responsibility in the event of damage caused to themselves, the ship, the property and equipment, third parties, or the property of third parties.
6.2- Health Status of Passengers
Any particular health condition must be declared at the time of reservation.
Furthermore, any passenger with a disability, an established health problem, or physical conditions incompatible with the proposed excursion (pregnant women, passengers with back issues, persons with reduced mobility or severe disabilities, or those with high cardiac conditions, etc.) must inform the company at the time of reservation, as indicated in Article 1.
In the event of non-declaration at the time of reservation, the captain may refuse embarkation to passengers whose health condition is not compatible with the excursion without any refund or compensation of any kind being required from the passenger.
The captain is not obliged to embark a passenger who has not disclosed their condition under these circumstances.
This passenger will still be required to pay for their ticket, and no refund or compensation can be made.
Moreover, if the captain believes that the health status or physical condition of a passenger who has validly reported their condition is incompatible with the excursion due to the weather conditions of the day, they are entitled to refuse the passenger’s embarkation.
In such a case, the passenger will be fully refunded.
6.3- Accessibility
This type of boat is incompatible with the transport of persons with reduced mobility or severe physical disabilities. In the event of non-declaration at the time of reservation, the captain has, among other things, the authority to refuse embarkation to passengers whose disability is not compatible with the excursion without any refund or compensation of any kind, as defined in Article 6.2.
Bicycles, strollers, even folded, motorcyclist equipment, or other oversized items are not permitted on board and cannot be embarked.
Article 7: Safety Instructions and Responsibility
The captain is the sole master on board their ship and informs passengers of the safety instructions to be followed.
Passengers must remain seated while the vessel is in motion.
They may only move around the vessel with the captain’s permission.
Smoking, including electronic cigarettes, is prohibited during navigation.
Minors are allowed on board only if accompanied by their parents and remain under the full supervision and responsibility of those parents.
Animals are prohibited on board.
Passengers agree in all cases to comply with the regulations established by Rêve de Nav’ aboard the vessel, as well as to obey the orders of the captain.
In the event of an accident due to passengers not respecting safety instructions, the Company shall not be held responsible for any damages that may occur.
Passengers are required to keep their personal belongings with them.
The company is not responsible for items on board, the degradation of personal property (jewelry, precious metals, personal papers and documents, sound or image recording devices, mobile phones, and glasses). In case of theft, loss, or damage, no compensation, refund, or indemnity will be made.
Article 8: Swimming
The company offers swimming breaks during its excursions.
Swimming is unsupervised and under your sole responsibility.
The Company is not responsible for passengers and their personal belongings during swimming.
The captain indicates to passengers a time for the end of swimming and return to the vessel.
The captain reserves the right to cancel a swimming break in light of weather conditions.
Passengers agree in all cases to comply with the regulations established by Rêve de Nav’ aboard the vessels, as well as to obey the orders of the captain.
Article 9: Menu, Special Diets, and Allergies
Persons who do not eat meat may request a meatless meal when making their reservation.
This request must be made in writing and within a reasonable timeframe to allow the team to prepare a special meal. No requests made less than 48 hours before the excursion departure will be accepted. The person may bring their own meal or beverage on board to supplement the menu.
The substitute meal will generally consist of raw vegetables, cheese, eggs, and rice.
In case of allergies or for any other special diet, individuals may either bring their complete meal or a supplement to the offered meal. No menu can be prepared to accommodate allergies such as gluten allergies or nut allergies. Individuals may bring their bread or snacks to supplement or replace the madeleines, crackers, or chocolate.
Ingredients on the Menu:
Snack: Banana and madeleines
Appetizer: Guava juice and Tropical juice, Mango punch (rum, mango, sugar, cinnamon, lemon, vanilla), Coconut punch (rum, coconut milk, sweetened condensed milk, cinnamon, vanilla, nutmeg).
Sausage, Fish rillettes, Wheat crackers.
Meal: Rice + Marinated chicken with Colombo powder, oil, salt, pepper, turmeric, fresh ginger, vegetarian peppers, lemon, garlic, and onions.
Fruit salad: Bananas, melon, pineapple, sugar, vanilla, cinnamon, lemon.
Coffee and tea.
Various chocolates.
Snack: Various biscuits.
Article 10: Regulations of the Vessel
The Rêve de Nav’ boat is subject to European regulations regarding the transport of passengers.
A navigation license, renewed after an annual inspection, certifying the vessel’s compliance with technical safety standards for passenger vessels (stability, buoyancy, strength, fire prevention and extinguishing, lifesaving equipment…).
The captain holds a Captain and Mechanic’s License.
These Licenses also imply the possession of a first aid training certificate and a Restricted Operator’s Radio Certificate (CRO).
Each crew member is required to undergo an annual medical fitness examination by a maritime doctor.
Special insurance covering all passengers.
Article 11: Groups, Agreements, and Privatization
11.1- Conditions
The reservation of a privatization service, or for a group, will only be effective upon the client’s acceptance of the quote and upon the payment of a deposit or the balance.
The payment of the remaining amount will be made no later than 10 days before the scheduled excursion date.
No refunds are possible in case of cancellation on your part within 72 hours. If cancellation is made at least 72 hours before the scheduled excursion time, the company will proceed with the refund. Note that transaction fees may apply depending on the payment method.
Registered participants will not be able to claim refunds based on unfavorable weather conditions.
Partial cancellations of group members within 72 hours also do not entitle to any refund or compensation.
In the event of cancellation by the company under the conditions described in Article 3.1, the full amount will be refunded to the client.
11.2- Groups and Agreements
The payment of the amount will be made according to the modalities defined in Article 11.1.
The conditions for refunds in case of cancellation by the company are as defined in Article 3.1, as well as the conditions for cancellations by the client defined in Article 3.3.
Within the framework of agreements or conventions established between Rêve de Nav’ and partners, their members or clients may benefit from discounts granted by Rêve de Nav’ (Promo Code).
Passengers will need to provide documents proving their stay or membership with one of our partner organizations, in which case the ticket price will be due at the current rate in full, without any recourse against Rêve de Nav’.
The establishment of an agreement does not allow third parties or third-party organizations to substitute the general terms and conditions of sale of Rêve de Nav’.
Article 12: Complaints
Any complaint against the company EI Rêve de Nav’ must be made within 15 days from the date of the excursion, by registered letter with acknowledgment of receipt to the head office of the company EI Rêve de Nav’ Croisière, Route de Beausoleil, 97141 Vieux Fort.
